Learn About Social Security Fairness Act Changes

What the Social Security Fairness Act Would Change

The Social Security Fairness Act is a proposed federal law that addresses how Social Security benefits are calculated for certain government workers. To understand what this act proposes, it helps to know that Social Security has special rules for people who receive pensions from government jobs where they did not pay Social Security taxes.

Currently, two rules reduce Social Security benefits for these workers: the Government Pension Offset (GPO) and the Windfall Elimination Provision (WEP). The GPO can reduce spousal and survivor benefits by up to two-thirds of a person's government pension amount. The WEP can lower a worker's own Social Security benefit by as much as half of their government pension. These rules have been in place for decades and affect roughly 2.3 million people according to the Social Security Administration.

The Social Security Fairness Act would eliminate both the GPO and WEP entirely. This means that people with government pensions would have their Social Security benefits calculated the same way as everyone else. The proposed changes would affect federal employees, state and local government workers, teachers, police officers, and firefighters who worked in positions where they did not contribute to Social Security.

For example, a retired teacher who spent 30 years in a state pension system without paying Social Security taxes might have received a $1,500 monthly Social Security check reduced by the WEP. Under the Fairness Act, that person's benefit could potentially be significantly higher because the reduction would not apply. Similarly, a surviving spouse of a government worker currently receiving a reduced spousal benefit might receive a larger monthly payment.

Practical Takeaway: The Fairness Act would change how benefits are calculated for government workers with pensions, potentially increasing monthly payments for affected individuals and their families. Understanding whether you fall into this category is important for long-term financial planning.

Who Would Be Affected by These Changes

The groups most directly affected by the Social Security Fairness Act would be workers and their families in several sectors. Government employees at federal, state, and local levels who did not participate in Social Security represent a significant portion of those impacted. This includes public school teachers, municipal workers, state highway patrol officers, and federal civilian employees hired before certain cutoff dates.

State and local teachers make up one of the largest groups. According to the American Federation of Teachers, approximately 1.6 million teachers work in school systems that do not participate in Social Security. These educators paid into teacher pension plans instead. Many of these teachers may have worked part-time jobs or had spouses who earned Social Security benefits, creating the situation where the GPO and WEP apply to their household.

Police officers and firefighters represent another significant population. Many municipal police and fire departments across the United States operate their own pension systems separate from Social Security. Officers who retired from these systems after 20 or 30 years of service often receive substantial pensions. When these individuals also receive Social Security from other work history, the WEP reduction kicks in.

Spouses and survivors of deceased government workers would also see changes. A widow or widower of a teacher or police officer who receives both a survivor pension and Social Security survivor benefits could see their total monthly income increase if the GPO is eliminated. Adult children receiving survivor benefits on a deceased parent's record could see similar increases.

Federal civilian employees who participated in the Federal Employees Retirement System (FERS) are affected differently than those in the Civil Service Retirement System (CSRS). CSRS employees did not pay Social Security taxes during their careers, making them subject to both GPO and WEP. FERS employees paid Social Security taxes, so only the WEP applies in limited situations. The Fairness Act would address both groups.

Practical Takeaway: Determine your employment history and pension source to understand whether you might be in a group affected by proposed changes. Government workers in education, law enforcement, fire services, and federal civilian employment should review their records most carefully.

The Windfall Elimination Provision and How It Currently Works

The Windfall Elimination Provision, commonly called the WEP, has been part of Social Security law since 1983. Congress created this rule based on the idea that people who receive government pensions without having paid Social Security taxes received an unfair financial advantage. The WEP attempts to correct this by reducing the Social Security benefit amount for affected workers.

Here's how the WEP currently operates: Social Security calculates retirement benefits using a three-tier formula. The first tier replaces a higher percentage of earnings, the second tier replaces a lower percentage, and the third tier replaces an even smaller percentage. The WEP modifies this formula for workers with non-covered pensions, flattening it so that the first tier pays out a smaller percentage of earnings. This reduction can be substantial for workers with smaller Social Security earnings histories or those who earned less during their working years.

The maximum WEP reduction is 50 percent of a person's government pension amount, but the reduction cannot exceed 50 percent of the Social Security benefit that would otherwise be received. In 2024, the maximum WEP reduction is $601 per month. For someone with a small government pension of $800 monthly, this could mean a reduction of $400 from their Social Security check. For someone with a larger $2,000 monthly pension, the reduction caps at the lesser of $1,000 (50 percent of pension) or 50 percent of their Social Security benefit.

Example calculations show the real impact: A retired postal worker born in 1958 with a $20,000 annual government pension and a $18,000 annual Social Security benefit would typically have their Social Security reduced by approximately $10,000 annually (50 percent of pension or 50 percent of Social Security benefit, whichever is less). This same person without the WEP would receive their full Social Security amount. The WEP creates a significant monthly reduction for affected workers, potentially lowering retirement income substantially.

The WEP includes some exceptions. Workers who had substantial Social Security coverage in at least 30 of their last 40 calendar years before reaching age 62 may face a reduced WEP impact. The provision has a "government pension offset" that can further limit the reduction. People who turned 62 before January 1, 2009 may also be grandfathered under certain conditions.

Practical Takeaway: Review your Social Security statement to see if the WEP is being applied to your benefit. Calculate what your benefit would be without this reduction to understand the total impact on your retirement income.

The Government Pension Offset Explained

The Government Pension Offset, or GPO, affects a different group of people than the WEP. While the WEP reduces a worker's own Social Security benefit based on a government pension, the GPO reduces family benefits. Specifically, it affects spousal benefits, survivor benefits, and ex-spouse benefits for people who also receive government pensions.

The GPO works by subtracting two-thirds of a person's monthly government pension from their family Social Security benefit. In practical terms, this means someone receiving a $1,500 monthly government pension would have their spousal or survivor benefit reduced by approximately $1,000 (two-thirds of $1,500). If their family benefit would have been $900 monthly, the GPO reduction would eliminate it entirely since the reduction exceeds the benefit amount.

Consider a concrete example: A retired police officer's widow receives a survivor pension of $2,000 monthly from the police department's pension system. She also receives a Social Security survivor benefit on her late husband's record. Without the GPO, her Social Security survivor benefit might be $1,200 monthly. However, two-thirds of her $2,000 pension is approximately $1,333, which exceeds her $1,200 Social Security benefit. This means her Social Security payment would be reduced to zero or nearly zero, despite having earned Social Security credits through her own work history.

The GPO currently affects approximately 700,000 people according to the Social Security Administration. Most of these individuals are spouses or survivors of government workers. Teachers' spouses sometimes face GPO reductions if they received spousal benefits. The widow or widower of a federal employee, state worker, or municipal employee may experience significant GPO-related benefit reductions.

Unlike the WEP, there are very limited exceptions to the GPO. People who were receiving both a government pension and family Social Security benefits before April 1
