Learn About Criminal Record Expungement in Texas

Understanding Criminal Record Expungement in Texas: What It Means

Criminal record expungement in Texas is a legal process that allows certain records of arrest or conviction to be sealed or destroyed. When a record is expunged, it is removed from public access, meaning employers, landlords, and most other people cannot see it when they conduct background checks. However, it's important to understand that expungement does not erase the arrest or conviction from existence—law enforcement agencies and certain government officials may still access the records under specific circumstances.

Texas uses two main terms related to clearing criminal records: "expunction" and "nondisclosure." While similar, they work differently. Expunction involves the actual destruction or return of records, while a nondisclosure order seals records so they are not visible to the general public but remain accessible to law enforcement. Both processes aim to give people a fresh start by limiting how often their past arrests or convictions appear in routine background checks.

The significance of expungement extends beyond privacy. A person whose record has been expunged may legally state they were not arrested or convicted for that offense in most situations. This matters greatly when filling out job applications, housing rental forms, or educational applications. In Texas, as of 2021, over 500,000 people had records expunged, showing how common this process has become for those seeking to move forward from their past.

Understanding expungement matters because the rules are complex and timelines vary based on the type of offense and case outcome. Some records may be expunged immediately after an arrest is made, while others require waiting periods of several years. Texas law has expanded opportunities for expungement in recent years, making it worth exploring whether your specific situation may qualify for this relief.

Practical Takeaway: Expungement is a legal process to seal or destroy criminal records, not to erase them completely. Law enforcement can still access expunged records, but the general public cannot. Understanding the difference between expunction and nondisclosure helps you know what level of record sealing you may pursue.

Types of Cases That May Be Expunged in Texas

Texas law allows expungement in several types of situations. The most straightforward category involves arrests that did not lead to conviction. If someone was arrested but the charges were dismissed, the case was no-billed by a grand jury, or the person was acquitted at trial, that arrest record typically becomes eligible for expungement. This covers a significant number of cases because many arrests do not result in criminal convictions.

Cases involving deferred adjudication also present expungement possibilities. In deferred adjudication, a person pleads guilty or no contest to charges, but the court delays the actual conviction. If the person completes probation successfully without incident, they may later seek expungement. Texas courts have allowed expungement in these cases for many years, and this remains a common path to clearing records.

Certain misdemeanor convictions may be expunged under specific conditions. For example, some misdemeanor convictions with low-level offenses may become eligible for expungement after a waiting period, which is typically two years from the completion of the sentence. This expansion of expungement rights for some misdemeanor convictions occurred gradually through Texas legislative changes.

Felony convictions are generally harder to expunge than misdemeanors or dismissed cases. However, some felony convictions may be expunged if they are later pardoned or if the person was convicted based on a DNA test result that was later found to be unreliable. Additionally, certain drug-related felonies may be expunged under specific circumstances. The Texas Legislature continues to review and adjust which felonies may be expunged, so the rules have shifted over time.

Juvenile cases have their own expungement rules. In Texas, many juvenile records are automatically sealed, meaning expungement may not be necessary. However, in some circumstances, individuals who had juvenile cases may petition for full expungement, particularly if they were arrested but not charged or if the case was dismissed.

Practical Takeaway: Dismissed cases and acquittals are the easiest to expunge, while deferred adjudication cases and some misdemeanors may also be expunged after certain time periods. Felony convictions face stricter requirements, though some circumstances allow for expungement even in felony cases.

Waiting Periods and Timeline Requirements for Texas Expungement

The timing for when you may seek expungement depends heavily on what type of case you have. For cases where charges were dismissed, no-billed by a grand jury, or resulted in acquittal, there is typically no waiting period. You may petition for expungement shortly after the case concludes, sometimes within weeks or a few months. The key requirement is that the case must be final and not subject to appeal by the prosecution.

For deferred adjudication cases, the waiting period is different. After successfully completing probation, a person may seek expungement relatively soon—sometimes immediately, depending on the offense type. However, some offenses have longer waiting periods, and the specific terms of probation matter. If probation was terminated early due to good behavior, expungement may be pursued earlier than if the full probation term was served.

Misdemeanor convictions that may be expunged typically require a two-year waiting period from the date of conviction or completion of the sentence, whichever is later. This means if someone was convicted, served their time, and completed probation, they would count from that final date before the two-year clock starts. In some cases, the waiting period may be shorter—sometimes one year for certain offenses—but two years is the standard timeframe in Texas law.

Felony convictions, when expungement is possible, usually have longer waiting periods. A typical timeframe is five to ten years, depending on the specific offense and circumstances. Some felonies cannot be expunged at all, regardless of how much time passes. This reflects the more serious nature of felony charges and is why understanding your specific offense type matters greatly.

It is important to note that the waiting period clock starts from specific dates: typically the date of conviction, the date probation ended, or the date the sentence was completed—not from the date of arrest. Calculating this correctly is crucial, as filing too early may result in your petition being denied. Additionally, if a case is appealed, the waiting period may be extended until appeals are exhausted and the case is truly final.

Practical Takeaway: Dismissed cases have no waiting period, deferred adjudication cases are expungeable after probation completion, misdemeanor convictions typically wait two years, and felony convictions (when expungeable) usually wait five to ten years. Always count from the correct end date—usually conviction or probation completion—not from arrest.

How the Expungement Petition Process Works in Texas

The expungement process in Texas begins with filing a petition in the court where the original case was handled. This petition is a formal legal document that requests the court to order expungement of your records. The document must include specific information such as your name, the case number, the charges involved, and the date of the arrest or conviction. It must also explain why you believe you are entitled to expungement under Texas law.

The petition is typically filed in the district court, even though some cases were originally handled in lower courts like justice courts or municipal courts. Once filed, a fee is usually required, though in some cases the fee may be waived if you demonstrate financial hardship. As of recent years, court filing fees for expungement petitions in Texas range from around $100 to $300, depending on the county and specific circumstances.

After the petition is filed, the prosecution (the district attorney's office or attorney general's office) has an opportunity to respond and object to the expungement. In many cases, the prosecution does not object, particularly in cases where charges were dismissed or the person was acquitted. However, in other cases, especially those involving more serious offenses, the prosecution may file a written response opposing the expungement request.

The court may then hold a hearing to consider the petition. In some cases, particularly straightforward ones, the judge may rule on the petition without a hearing. At a hearing, both sides may present arguments. You or your representative may explain why expungement is appropriate, while the prosecution may argue why records should not be sealed or destroyed. The judge then makes a decision based on Texas law and the specific facts of your case.
